Outdated Regulations for Philadelphia Short-Term Rentals

In July 2015, an amendment to the Philadelphia Code came into effect, allowing Airbnb rentals with specific conditions. The city categorized short-term rentals (STR) as "limited lodging," applicable when renting a property for less than 30 days, subject to outlined requirements.

Standards

A dwelling unit may be used for limited lodging subject to compliance with all of the following minimum requirements:

  • Limited lodging should not exceed three unrelated individuals (including the property owner) residing together, maintaining a household living unit with common housekeeping facilities.
  • Limited lodging must be secondary to the primary residential use of the dwelling unit, ensuring it does not alter the residential character of the building.
  • No separate entrance visible from the street shall be provided exclusively for limited lodging use.
  • Limited lodging should not disrupt the residential character of the neighborhood, prohibiting disturbances such as noise, vibrations, glare, or odors
  • The use of accessory signs is prohibited.
  • Guests of lodgers are permitted between 8:00 a.m. and 12:00 a.m.
  • Adherence to the Philadelphia Fire Code, including the installation of smoke and carbon monoxide alarms throughout the dwelling unit.
  • Lodgers must be informed of trash and recycle collection days, with proper containers provided.
  • Lodgers must be notified of noise regulations, with violators subject to fines and penalties as per Chapter 10-400 553 of The Philadelphia Code.
  • The primary resident conducting limited lodging must maintain records for at least one year, demonstrating primary residency, dates of limited lodging, and the number of lodgers.
  • The owner or designee must provide contact information to lodgers for addressing complaints regarding the condition, operation, or conduct of occupants, taking necessary actions to resolve such issues.
  • All limited lodging is subject to the Fair Practices Ordinance, Chapter 9-1100.

Licensing Requirements and Fees for Vacation Rentals in Philadelphia

To comply with the Philadelphia Code, Airbnb rentals must adhere to specific conditions, including obtaining a permit if the property is rented for more than 90 days a year.

Applicants for a new license or license renewal must fill out an application provided by the Department of Licenses and Inspections. The application should include the following details:

  • Name and address of the property owner(s)
  • Property address and type of dwelling
  • Name, address, and phone number of the property's managing agent
  • The owner’s commercial activity license number, if the owner is required to have such license.
  • If any information in the license application changes during the license term, the owner must promptly provide updated details in writing to the Department within ten business days of the change.

The annual license fee for a rental license under Section 9-3902 is $55 for each dwelling or rooming unit, with a maximum annual fee of $22,000 per dwelling.

Licenses are non-transferable, and if property ownership changes during the license term, the new owner must obtain a new license within ten business days of the ownership transfer.

LLC Ownership Allowed

If the property owner is not an individual or a publicly traded company, the application must identify, along with the owner, the name and preferred mailing address of each natural person with an equity interest exceeding 49% in the property or owner's value. 

If no individual holds such an interest, the application should specify the names and addresses of the two individuals with the largest equity interest in the property.

Owning Multiple Short-Term Rental Properties

Owners with more than one short-term (Airbnb) rental property must complete a separate application for the registration of each property, as stipulated by the Department.

Taxes

Bill No. 210081, approved on June 23, 2021, and effective from April 1, 2022, establishes that limited lodging owners must not permit occupancy by more than three individuals (including the owner and lodgers) who are unrelated by blood, marriage, adoption, or foster-child status, unless they are Life Partners.

Responsible Agent

The city of Philadelphia mandates a responsible agent, referred to as a Managing Agent, for any property requiring a rental license, Vacant Lot License, Vacant Structure License, or Vacant Waterfront Structure License.
